State Duma passed in the third, final seating law “On introducing amendments in individual RF regulatory acts to protect rights of participants of shared construction”. According to Gazeta.ru, this document obliges developers execute law on shared construction (they will be fined for bill schemes), extends their number through sub-lessees and exempts from VAT.

 “Amounts of fines, which developers will be charged with, look trifling, comparing to scope of construction business”, Alexander Ermolenko, Head of FBK-Legal Corporate Practice believes. Another issue leaving questions is an attempt to solve problems of deceived interest-holders through local authorities. “Regional and municipal authorities should share responsibility with interest-holders, at least, because construction permission is within competence of local authorities”, Ermolenko noted. Another matter, the expert continued, is that local authorities always do not have enough money and when they get incomplete construction, they have nothing to cheer up the affected interest-holders.
